These Terms of Service govern your access to and use of the MathChat™ service, which include our online application, APIs, and related services for individuals, along with any associated software applications and websites (collectively, the "Services"). By using these Services, you agree to these Terms, which form a contract between you and The Crafty Weasel LLC, an Oregon Limited Liability Company. These Terms include our Service Terms and contain provisions regarding arbitration for resolving disputes.

- Misrepresenting outputs as human-generated when they are not.
- Disrupting or circumventing any restrictions, protections, or safety measures built into our Services.
- Using our outputs to create competing models or services.
Software: Our Services may include downloadable software, such as mobile applications, which may update automatically. Some of this software may include open-source components governed by separate licenses.
Third-Party Services: Some aspects of our Services may involve third-party software, products, or services ("Third-Party Services") and may include output generated by these third parties ("Third-Party Output"). These are subject to their own terms, and we aren't responsible for them.
Feedback: We welcome your feedback, which you agree we may use without obligation or compensation.
Content
Your Content: When you provide input to our Services ("Input") and receive output ("Output"), these collectively form your content ("Content"). You are responsible for ensuring your Content complies with these Terms and applicable laws. You represent that you have all necessary rights and permissions to provide your Input.
Content Ownership: You retain ownership of your Input, and we assign to you any rights we may have in your Output, to the extent allowed by law.
Content Similarity: Due to the nature of AI, the outputs you receive may be similar to those of other users. This assignment of rights doesn't extend to similar outputs generated for others.
Our Use of Content: We may use your Content to enhance and develop our Services, comply with legal obligations, and ensure the safety and integrity of our Services.
Opt-Out: If you don't want us to use your Content to train our models, you can opt out by following the instructions provided in our Help Center. Note that this may impact the effectiveness of our Services for your use case.
Accuracy Disclaimer: AI and machine learning are evolving technologies. Although we work continuously to improve our Services, outputs may sometimes be inaccurate, incomplete, or misleading. You should evaluate outputs before relying on them for important decisions.
Intellectual Property Rights
We, along with our affiliates, hold all rights in the Services. Any use of our brand assets must comply with our Brand Guidelines.
Paid Subscriptions
Billing: When purchasing a subscription, you must provide accurate payment information. For recurring subscriptions, charges will continue until you cancel. Taxes are your responsibility, and we will collect them as required. Failure to pay may result in a downgrade or suspension of your account.
Cancellation and Refunds: You may cancel at any time, but payments are non-refundable except where required by law. Upon cancellation we will maintain your service level until the end of the period you have paid for.
Price Changes: We may adjust our prices. You'll receive at least 30 days' notice before any price increase takes effect at your next renewal.
Termination and Suspension
We may suspend or terminate your access if you breach these Terms, if legally required, or if your use poses a risk to us or others. Accounts inactive for over a year may be terminated unless you have a paid subscription. If you believe your account was wrongly terminated, you can appeal.
Service Discontinuation
If we decide to stop offering the Services, we will provide advance notice and refund any prepaid, unused amounts.
Disclaimers
The Services are provided “as is.” To the fullest extent allowed by law, we disclaim all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee uninterrupted, accurate, or error-free service.
Limitation of Liability
We and our affiliates aren't liable for indirect, incidental, special, or consequential damages. Our liability is capped at the greater of $100 or the amount you paid for the Service within the past 12 months. Some jurisdictions may have different limitations.
Indemnification
If you are a business, you agree to indemnify us for claims arising from your use of the Services or violation of these Terms.
Dispute Resolution
Mandatory Arbitration and Waivers: Any disputes will be resolved through binding arbitration, with limited exceptions. Class actions and jury trials are waived.
Batch Arbitration: Claims filed by multiple parties will be grouped into batches for resolution.

General Terms
Assignment: You cannot assign these Terms without our consent. We may assign our rights to an affiliate or successor.

Governing Law: These Terms are governed by Oregon law, with exclusive jurisdiction in Portland, Oregon courts, except as specified for arbitration.
